SAN FRANCISCO, March 9, 2026 — Anthropic has filed a lawsuit against the U.S. Department of Defense, seeking to prevent the agency from placing the company on a restricted list that would bar it from federal contracts due to its refusal to allow military use of its AI models.

The complaint, filed in federal court in San Francisco, argues that the Pentagon’s proposed blacklisting violates Anthropic’s constitutional rights and exceeds statutory authority. The company claims the Defense Department is pressuring it to remove clauses in its terms of service that prohibit military applications of Claude models, including weapons development, targeting, or surveillance.

Anthropic CEO Dario Amodei stated: “We built Claude to be helpful and safe for all people. We will not compromise those principles to secure government contracts.” The company has maintained a policy against military use since its founding, citing risks of misuse in conflict zones.

The dispute stems from a 2025 Defense Department directive requiring AI providers to remove restrictions on military applications for eligibility in federal programs. Anthropic refused, prompting the Pentagon to initiate a review that could lead to blacklisting under the National Defense Authorization Act.

The lawsuit seeks a declaratory judgment that the restrictions are lawful and an injunction against any blacklisting or contract denial. Anthropic argues the policy infringes on free speech and forces the company to choose between its ethical commitments and access to government business.

The Pentagon declined to comment on pending litigation. The case could set precedent for how private AI companies balance commercial interests with ethical boundaries in national security contexts.

Anthropic has secured significant commercial contracts, including with Amazon and Google Cloud, but remains one of the few major AI providers explicitly barring military use. The outcome may influence other companies facing similar demands.
